Terms & Conditions

Welcome to The Earthy Meals (“we,” “us,” “our”). By accessing our website, placing an order, or purchasing any product, you agree to these Terms & Conditions (“Terms”).

If you do not agree, please do not use our website or services.

1) About Our Products

The Earthy Meals prepares and sells baby and child meals, including purées, textured meals, finger foods, and children’s plates (“Products”). Products are intended for children generally between 6 months to 5 years, but every child is different.

You are responsible for:

  • checking allergen information

  • confirming suitability for your child’s age, development, and dietary needs

  • supervising your child while eating (especially for finger foods)

We do not provide medical advice. If your child has allergies, medical conditions, swallowing concerns, or dietary restrictions, consult a qualified healthcare professional before ordering.

2) Ordering & Cut-Off Times

  • Orders placed before Monday 2:00 PM (Calgary time) are eligible for Wednesday delivery.

  • Orders placed after Monday 2:00 PM will be scheduled for delivery the following week.

We may close ordering early if capacity is reached.

3) Delivery

We deliver to eligible areas in and around Calgary (delivery zones may change over time and are shown at checkout).

Delivery details:

  • You must provide a complete and accurate delivery address, delivery instructions, and a valid contact number.

  • Someone must be available to receive the order or you must provide safe drop-off instructions.

  • If we cannot complete delivery due to incorrect address, no access, unsafe conditions, or no response, the order may be returned or disposed of for food safety reasons. In these cases, refunds are not guaranteed.

Risk Transfers at Delivery: Once the order is delivered to your address (or left according to your instructions), responsibility for safe handling and storage transfers to you.

4) Food Safety, Storage & Handling (Important)

Our meals are perishable. For safety and quality:

  • Refrigerate promptly after delivery.

  • Follow the storage and reheating instructions provided with your order (or on the product listing).

  • Do not consume products that smell off, look unusual, have damaged packaging, or have been left unrefrigerated beyond safe time limits.

We are not responsible for issues caused by improper storage, handling, reheating, or consumption after recommended timelines.

5) Allergens & Cross-Contact

We take care with ingredients and kitchen practices; however:

  • Our kitchen may handle common allergens such as milk, egg, wheat/gluten, soy, sesame, peanuts, tree nuts, fish, shellfish, and others.

  • Cross-contact may occur. We cannot guarantee any product is 100% allergen-free.

It is your responsibility to review allergens and ingredients before ordering. If you have questions, contact us beforeplacing your order.

6) Substitutions & Availability

Because we cook with seasonal and fresh ingredients, we may occasionally substitute:

  • ingredients (with something comparable), or

  • menu items (if supply issues occur)

We will aim to keep substitutions reasonable and consistent with the product category/age stage.

7) Pricing, Payments & Taxes

  • All prices are listed in CAD.

  • Prices may change at any time without notice.

  • Taxes and delivery fees (if applicable) are shown at checkout.

  • Payment must be completed at checkout. Orders are not confirmed until payment is successfully processed.

If a pricing error occurs, we may cancel the order and issue a refund or contact you to confirm the correct price.

8) Subscriptions 

If you purchase a subscription:

  • you authorize recurring billing at the stated frequency and price

  • you are responsible for managing your subscription through your account (where available)

  • changes or cancellations must be made before the weekly cut-off to apply to the next delivery cycle

  • Cancellations and pauses can be requested by emailing info@theearthymeals.com before the weekly cut-off.

Subscription availability, terms, and billing dates may be described on the subscription product page and are part of these Terms.

9) Refunds, Credits & Order Issues

Because food is perishable, all sales are generally final, except as outlined below.

Report an Issue

If there is an issue with your delivery (missing item, incorrect item, damaged packaging, quality concern), you must email us within 4 hours of delivery at: info@theearthymeals.com

Include:

  • your full name + order number

  • photos (required for damaged items/quality concerns)

  • a clear description of the issue

What We May Offer (At Our Discretion)

If your claim is valid, we may offer:

  • a replacement (when possible)

  • store credit

  • partial refund

  • full refund (rare; case-by-case)

We do not offer refunds for:

  • change of mind

  • uneaten food

  • taste preferences

  • issues caused by incorrect storage/handling after delivery

  • missed delivery due to incorrect address or no safe drop-off

10) Customer Requests & Meal Adjustments

If you have concerns about certain meals, you may request a swap when possible. Requests must be made before preparation, and availability is not guaranteed. Contact us as early as possible.

11) Gift Cards 

Gift cards:

  • are non-refundable

  • have no cash value

  • cannot be exchanged for cash

  • may have expiry rules as permitted by law

  • are redeemable only on our website unless stated otherwise

We are not responsible for lost, stolen, or misused gift card codes.

12) Promotions & Discount Codes

Discount codes:

  • may be limited to one per order unless stated

  • cannot be applied retroactively

  • may exclude certain items

  • may be changed or cancelled at any time

13) Website Use & Intellectual Property

All website content (logos, graphics, photos, text, recipes, branding) is owned by The Earthy Meals or licensed to us and may not be copied, reused, or reproduced without written permission.

You may not misuse our website, attempt unauthorized access, or interfere with site functionality.

14) Limitation of Liability

To the maximum extent permitted by law:

  • The Earthy Meals is not liable for any indirect, incidental, special, consequential, or punitive damages.

  • Our total liability for any claim related to an order is limited to the amount you paid for that order.

Food products carry inherent risks (including allergy risks and choking hazards). By purchasing, you accept responsibility for ensuring suitability and safe consumption for your child.

15) Indemnity

You agree to indemnify and hold harmless The Earthy Meals from claims, losses, liabilities, damages, and expenses arising from:

  • your misuse of products

  • failure to follow storage/handling instructions

  • inaccurate information provided by you (address, allergies, delivery instructions)

  • your breach of these Terms

16) Privacy

Your use of our website is also subject to our Privacy Policy. By using our site, you consent to the collection and use of your information as described there.

17) Force Majeure

We are not responsible for delays or failures due to events beyond our control, including weather, road conditions, supply chain disruption, power outages, illness, emergencies, or other unforeseen events.

If this happens, we may reschedule delivery, provide credit, or refund at our discretion.

18) Changes to These Terms

We may update these Terms at any time. The version posted on our website is the current version. Continued use of our website or services means you accept the updated Terms.
