The Earthy Meals – Terms and Conditions (One-Time Orders)

These Terms and Conditions (“Terms”) govern all one-time purchases made from The Earthy Meals (“TEM,” “we,” “our,” “us”). By placing an order, you (“Customer,” “you,” “your”) agree to these Terms.

1. Agreement to Terms

1.1. By placing a one-time order on theearthymeals.com, you agree to comply with and be bound by these Terms.
1.2. If you do not agree, please do not place an order.
1.3. We may update these Terms at any time. Continued use of our service after any updates indicates your acceptance of the revised Terms.

2. Services Provided

2.1. The Earthy Meals prepares fresh, pre-made baby and toddler meals for children aged 6 months to 5 years within Calgary and surrounding areas.
2.2. All meals are made in an Alberta Health Services (AHS) licensed commercial kitchen.
2.3. Ingredient lists and pricing are available at theearthymeals.ca.
2.4. Allergy Notice: While we take precautions, we cannot guarantee that meals are free from allergens such as dairy, gluten, nuts, eggs, soy, or other allergens.

3. Ordering, Delivery & Pickup

3.1. All one-time orders must be placed by Sunday at 2:00 PM for delivery the same week.
3.2. Deliveries are made on Wednesdays or Thursdays, depending on your location. Your delivery day will be confirmed by email.
3.3. Delivery is considered complete once meals are left at your provided address or designated drop-off location.
3.4. TEM is not responsible for lost, stolen, or damaged meals after delivery is completed.
3.5. If an order cannot be delivered due to incorrect address, inaccessibility, or no safe drop-off location, the order may still be charged in full.
3.6. Any concerns about delivered meals must be reported within 4 hours to info@theearthymeals.com.

4. Meal Storage, Handling & Consumption

4.1. Meals must be refrigerated immediately after delivery.
4.2. Meals are safe to consume within 24 hours in the fridge, or they may be frozen for up to 1 month.
4.3. Follow reheating instructions and ensure meals are heated thoroughly. Always check temperature before feeding your child.
4.4. Children must be supervised while eating. TEM is not liable for choking, allergic reactions, or food sensitivities.

5. Pricing & Payments

5.1. Prices listed on theearthymeals.com are subject to change without notice.
5.2. Full payment is required at checkout.
5.3. We accept debit and credit cards via our secure payment processor.
5.4. All payments are non-transferable.

6. Refunds & Order Changes

6.1. Refund requests must be submitted within 4 hours of delivery.
6.2. Refunds are issued at our sole discretion and only for valid concerns (e.g., incorrect order, damaged meals, spoilage).
6.3. No refunds will be issued for:

  • Missed deliveries due to incorrect addresses or no safe drop-off spot

  • Change of mind or child refusal

  • Improper storage or delayed consumption

  • Requests made outside the 4-hour window
    6.4. Orders cannot be changed after Sunday at 2:00 PM.

7. Limitation of Liability

7.1. TEM is not responsible for:

  • Allergic reactions or food sensitivities

  • Choking hazards or improper feeding practices

  • Foodborne illness caused by improper storage or reheating

  • Delivery delays outside our control

7.2. Force Majeure: We are not liable for delays or non-delivery due to extreme weather, natural disasters, power outages, kitchen emergencies, transportation delays, illnesses, or any event beyond our control.

7.3. By placing an order, you agree to hold TEM harmless from all claims related to meal consumption or delivery.

8. Dispute Resolution

8.1. We encourage resolving concerns through direct communication first. Contact info@theearthymeals.com.
8.2. If resolution cannot be reached, disputes must be handled through mediation or arbitration in Alberta, Canada.
8.3. You waive the right to participate in any class-action lawsuit against TEM.

9. Third-Party Services

9.1. We may use third-party delivery partners or payment processors.
9.2. TEM is not responsible for errors, delays, or service interruptions caused by these partners.

10. Intellectual Property

10.1. All content on theearthymeals.com—including branding, recipes, product names, photos, and written content—is the exclusive property of The Earthy Meals.
10.2. You may not copy, reproduce, or distribute any materials without written permission.

11. No Medical or Dietary Advice

11.1. TEM does not provide medical or nutritional advice.
11.2. Always consult a pediatrician regarding allergies, feeding readiness, and introducing new foods.

12. Promotions & Discounts

12.1. One-time order promotions, coupons, and discounts are subject to change or cancellation.
12.2. Discounts cannot be combined unless stated otherwise.

13. Termination of Orders

13.1. We reserve the right to refuse service at our discretion, including for:

  • Abusive behaviour

  • Repeated missed deliveries

  • Fraudulent activity
    13.2. No refunds will be issued if service is terminated due to policy violation.

14. Parent Responsibility

Parents/guardians are responsible for selecting the appropriate meals based on their child’s age, dietary needs, and developmental stage. The Earthy Meals is not liable for incorrect selections.
